SB 1314 & HB 5182 protect Illinois cigar retailers and create a level playing field.

This bill requires qualifying remote and online sellers to collect and remit Illinois tobacco taxes on products sold into the state. Local retailers already comply with these rules. Remote & online sellers should comply as well.

Beginning January 1, 2027, the bill updates the tobacco tax formula to 45% of the actual cost paid by a distributor or remote seller. Importantly, SB 1314 & HB 5182 establish a $0.75 per-cigar tax cap on premium cigars, from 2027 through 2029. This provides predictability and protects small businesses from excessive taxation.
